1.Acceptance of the Terms
These Terms of Service (the “Terms”) govern your access to and use of the BridgeShip website, applications, APIs, and related services (collectively, the “Services”), provided by BridgeShip (“BridgeShip”, “we”, “us”).
By creating an account, generating a shipping label, completing a payment, or otherwise using the Services, you confirm that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
2.Eligibility
To use the Services you must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into a binding contract.
If you use the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, “you” refers to both you and the entity.
You must not use the Services if you are subject to applicable sanctions or restrictions, or located in a jurisdiction where the use of the Services would be unlawful.
3.Account creation
To use most features of the Services you must create an account. You may register with an email and password or use a supported third-party authentication provider (such as Google).
You agree to provide accurate, current, and complete information, and to keep it up to date.
You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at security@bridgeship.app if you suspect any unauthorized access or use.
4.User responsibilities
When using the Services, you agree to:
- Comply with all applicable laws and regulations, including export, customs, tax, sanctions, and consumer-protection laws.
- Provide accurate and complete information for shipments, payments, customs declarations, and account profiles.
- Use the Services only for lawful purposes and consistent with these Terms.
- Not interfere with or disrupt the Services, attempt to access them by unauthorized means, or probe, scan, or test their security.
- Not use the Services to harm, defraud, or mislead third parties.
5.Information you provide
You are solely responsible for the accuracy of the information you provide through the Services, including sender and recipient details, parcel dimensions and weights, declared values, descriptions of contents, and any tax or customs identifiers.
Incorrect or incomplete information may result in shipment delays, additional fees from carriers, customs holds, returns to sender, or destruction of the parcel by competent authorities. BridgeShip is not responsible for those outcomes.
6.Label generation
The Services allow you to generate shipping labels through integrations with carrier and aggregator partners. By generating a label, you authorize BridgeShip and its partners to create and transmit the shipment to the selected carrier on your behalf.
Each label is valid only for the parcel and the dates indicated. Reuse, alteration, or duplication of labels may constitute fraud and may result in chargebacks, fees, or suspension of your account.
Carriers may inspect parcels, weigh and measure them, and adjust the price accordingly. You agree that BridgeShip may pass through any such adjustments, fees, or penalties to your account.
7.Payments
Payments for the Services are processed by Stripe. By submitting a payment, you authorize Stripe to charge your selected payment method for the amount displayed at checkout, in U.S. dollars (USD) unless otherwise stated.
You represent that you are authorized to use the payment method provided. We may rely on fraud-prevention signals from Stripe and our own systems to review, decline, or reverse transactions that appear suspicious.
Late, failed, or reversed payments may result in restrictions on your account, including suspension of new shipments and recovery of outstanding amounts through lawful means.
Abusive chargebacks — including disputes filed for transactions clearly delivered or for services rendered as described — may result in account suspension and the recovery of associated costs.
8.Wallet
BridgeShip may offer a prepaid balance (the “Wallet”) that you can fund in advance and use to pay for labels and other Services.
Wallet balances are denominated in USD, are not bank deposits, do not earn interest, and are not insured. Funds added to the Wallet are intended to be used to purchase Services and are non-transferable.
We may apply credits, promotional balances, or referral bonuses to the Wallet under specific terms communicated at the time of the offer. Promotional credits may have an expiration date and may not be withdrawn for cash.
Refund of unused Wallet funds, when applicable, follows the rules below in the Refunds section and any additional limits required by law or by our payment provider.
9.Refunds
Unused shipping labels that are not scanned by the carrier may be eligible for a refund, subject to the carrier's policy and our internal review.
Refunds are returned to the original payment method or to the Wallet, at our discretion and consistent with the rules of the payment provider.
Refunds for unused shipping labels may take up to twenty (20) calendar days to be processed, depending on the carrier.
Carrier-imposed fees, adjustments, or fines are generally non-refundable. Refund processing times depend on the carrier, the payment provider, and the user's bank.
10.Cancellations
Shipments may be cancelled before the carrier has accepted or scanned the parcel, subject to the carrier's policies. Once a carrier has accepted the parcel, cancellation may not be possible.
You may close your BridgeShip account at any time. Open shipments, pending payments, and active disputes must be resolved before closure can be finalized.
11.Partner carriers
BridgeShip is not a carrier. Physical transportation, customs clearance, and delivery are performed by third-party carriers and partners, which may include USPS, UPS, FedEx, DHL, and other regional or international providers.
Each carrier has its own service rules, dimensions and weight limits, declared-value limits, restricted-item lists, and claims procedures, which apply in addition to these Terms.
12.Tracking
Tracking information is provided by the carrier and made available through the Services as a convenience. Tracking events may be delayed, incomplete, or temporarily unavailable.
BridgeShip is not responsible for the accuracy or timeliness of tracking events provided by carriers.
13.Customs declarations
For international shipments, you are responsible for accurately declaring the contents, value, and category of the parcel, and for providing any identifiers required by the destination country (for example, EIN, CPF, or CNPJ).
Taxes, duties, tariffs, and other fees charged by customs or the destination country are not controlled by BridgeShip and are not included in the price unless explicitly stated. The recipient or sender may be required to pay these amounts directly to the relevant authority or carrier.
Customs authorities may inspect, hold, return, or destroy parcels at their discretion. BridgeShip has no authority over those decisions.
14.Use restrictions
You may not use the Services to:
- Violate applicable laws or regulations, including export, sanctions, customs, intellectual-property, or consumer-protection laws.
- Ship items that are prohibited or restricted by the carrier, by the origin country, or by the destination country.
- Defraud BridgeShip, its partners, carriers, payment providers, or other users.
- Reverse engineer, scrape, or interfere with the operation of the Services.
- Resell or sublicense the Services without our prior written consent, except as expressly permitted.
15.Prohibited and restricted items
You are responsible for confirming that the items you ship are legal in the origin country, the destination country, and any transit country, and that they are accepted by the chosen carrier.
Examples of items that are commonly prohibited or restricted include, but are not limited to:
- Weapons, firearms, ammunition, and parts thereof.
- Explosives, fireworks, and other hazardous materials.
- Illicit drugs and controlled substances.
- Counterfeit, pirated, or otherwise infringing goods.
- Currency, negotiable instruments, and items used to evade taxes.
- Live animals, human remains, and biological samples without proper authorization.
- Perishable food items not allowed by the carrier or destination country.
- Goods otherwise prohibited by applicable law or by the carrier's published restrictions.
Shipping prohibited items may result in seizure or destruction by authorities, fines, civil and criminal penalties, and suspension or termination of your BridgeShip account.
16.Account suspension and termination
We may suspend, restrict, or terminate your account, with or without notice, if we reasonably believe that you have violated these Terms, applicable law, or the rules of a carrier or payment provider, or if continued access would create a risk to BridgeShip, its users, or third parties.
Upon termination, your right to use the Services ends immediately. Sections of these Terms that by their nature should survive termination — including, without limitation, payment obligations, limitations of liability, indemnities, intellectual-property rights, and dispute-resolution provisions — will survive.
17.Limitation of liability
To the maximum extent permitted by applicable law, BridgeShip and its officers, directors, employees, agents, affiliates, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, or data, arising out of or related to your use of the Services.
BridgeShip does not guarantee:
- Delivery times or carrier service levels.
- The outcome of customs inspections or border controls.
- Carrier delays, lost or damaged parcels, or carrier service interruptions.
- Taxes, duties, or other fees imposed by governments or carriers.
- Uninterrupted availability of the Services.
To the extent BridgeShip is held liable for any reason, our aggregate liability for any claim arising out of or related to the Services will not exceed the amount paid by you to BridgeShip for the specific shipment giving rise to the claim, or one hundred U.S. dollars (USD 100), whichever is greater, except where a higher amount is required by mandatory law.
18.Disclaimer of warranties
The Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation, except where such warranties cannot be excluded by applicable law.
BridgeShip does not warrant that the Services will be error-free, secure, or available at any particular time or location, or that any defects will be corrected.
19.Intellectual property
The Services, including the BridgeShip name and logo, software, design, text, graphics, and other content (excluding user content), are owned by BridgeShip or its licensors and are protected by intellectual-property laws.
Subject to your compliance with these Terms, BridgeShip grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. All other rights are reserved.
You retain ownership of the data and content you submit to the Services. You grant BridgeShip a worldwide, non-exclusive, royalty-free license to use, process, store, transmit, and display such content as necessary to provide and improve the Services.
20.Service availability
BridgeShip strives to keep the Services available with reasonable reliability but does not guarantee uninterrupted operation. The Services may be temporarily unavailable due to maintenance, third-party outages (including carriers and payment providers), or events outside our control.
21.Changes to the platform
We may add, modify, or discontinue features, integrations, carriers, or other components of the Services at any time, with or without notice, in order to improve the platform, address legal or operational requirements, or for other legitimate reasons.
22.Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the platform, by email, or by other appropriate means before they take effect. The “Last updated” date at the top of this page indicates the most recent revision.
Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
23.Governing law
These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-law principles, except where mandatory consumer-protection laws of the user's country of residence apply.
24.Dispute resolution
We encourage you to contact us first at legal@bridgeship.app to resolve any dispute informally before initiating formal proceedings.
If a dispute cannot be resolved informally, it will be brought exclusively in the competent courts of the Commonwealth of Massachusetts, United States, except where mandatory law of the user's country of residence requires another venue.
Nothing in these Terms limits any right that cannot be waived under applicable law, including rights of consumers under local law.
